Delitev oblasti - zakaj sploh obstaja?
Predstavljaj si, da bi imel en človek vso oblast v državi. Lahko bi sprejemal zakone, jih izvajal in še sodil tistim, ki jih kršijo. To bi bila popolna delitev oblasti v rokah ene osebe, kar bi pomenilo konec demokracije.
Francoski mislec Montesquieu je že pred stoletji ugotovil, da je treba oblast razdeliti na tri dele. Tako nobena veja oblasti ne more postati premočna in zlorabiti svojega položaja.
Sistem zavor in ravnovesij pomeni, da se vse tri veje - zakonodajna, izvršilna in sodna - medsebojno nadzorujejo. Ko ena poskuša prekoračiti svoje pristojnosti, jo drugi dve ustavita.
💡 Pametno za test: Delitev oblasti ni le teorija - vsak dan vidiš, kako parlament nadzoruje vlado, sodišča razveljavijo neustavne zakone, predsednik pa razglasi zakone.
Zakonodajna oblast - tukaj nastajajo zakoni
Državni zbor je srce zakonodajne oblasti. 90 poslancev, ki jih voliš ti in vsi drugi državljani, odločajo o zakonih, proračunu in še marsičem.
Dva poslanca imata posebno vlogo - predstavljata italijansko in madžarsko narodno skupnost. Državni zbor lahko razreši vlado z nezaupnico, če ni zadovoljen z njenim delom.
Državni svet je drugi del zakonodajne oblasti, vendar ima manj moči. 40 svetnikov ni izvoljenih na splošnih volitvah - predstavljajo različne skupne, kot so delavci, delodajalci ali občine.
💡 Pozor na test: Državni svet lahko z odložilnim vetom zahteva, da državni zbor o zakonu še enkrat glasuje!
Izvršilna oblast - od zakona do prakse
Vlada Republike Slovenije je motor države. Ko državni zbor sprejme zakon, vlada poskrbi, da se ta zakon tudi izvaja v praksi.
Predsednik vlade (premier) vodi vlado in ministre. Vsak minister skrbi za svojo področje - eden za šolstvo, drugi za zdravje, tretji za finance. Vlada tudi predlaga nove zakone državnemu zboru.
Predsednik republike ima drugačno vlogo - je predvsem predstavnik države v tujini. Volimo ga neposredno za pet let, njegova glavna naloga pa je razglašanje zakonov in predstavljanje Slovenije.
💡 Pomembna razlika: Predsednik republike NE vodi vlade! To naredi predsednik vlade. Prva je bolj simbolična funkcija, druga ima pravo politično moč.
Sodna oblast - kjer se išče pravica
Sodišča so tista, ki razlagajo zakone in sodijo, ko nekdo krši pravila. Imamo različne vrste - od okrajnih do vrhovnega sodišča, odvisno od tega, kako pomemben je spor.
Neodvisnost sodnikov je ključna - nihče jim ne sme ukazovati, kako naj sodijo. Sodijo lahko le po zakonu in svoji vesti, ne pa po željah politikov.
Ustavno sodišče je posebnež - ni del običajnega sodstva, ampak nadzoruje, ali so zakoni v skladu z ustavo. Če ugotovi, da nek zakon krši ustavo, ga lahko razveljavi.
💡 Za razumevanje: Ustavno sodišče je kot "varuh ustave" - lahko ustavi celo državni zbor, če ta sprejme neustaven zakon!
Kako sistem deluje v praksi
Ko vlada predlaga nov zakon o štipendijah, se zgodi prava veriga preverjanj. Državni zbor o njem razpravlja in glasuje, državni svet lahko vloži veto, predsednik republike ga mora razglasiti.
Če nekdo meni, da je zakon neustaven, se lahko obrne na ustavno sodišče. To je popoln primer sistema zavor in ravnovesij v akciji.
Državni zbor lahko vladi izglasuje nezaupnico, če ni zadovoljen z njenim delom. Poslanci lahko ministrom tudi postavljajo neprijetna vprašanja o njihovem delu.
💡 Hitra primerjava: Državni zbor (90 poslancev, neposredne volitve, sprejema zakone) vs. Državni svet (40 svetnikov, posredne volitve, svetuje in odlaga).
Ključne stvari za test

I think it’s very much worth it and you’ll end up using it a lot once you get the hang of it and even after looking at others notes you can still ask your Artificial intelligence buddy the question and ask to simplify it if you still don’t get it!!!
